The Legal (aka boring, but necessary) Stuff
DISCLAIMER: All original photos taken, edited, and provided by Kelly Ralph shall remain with the Photographer. All photos are copyrighted. The digital images (hereinafter collectively the "images”) created by the Photographer remain the property of the Photographer. This includes the right to use, reproduce, and distribute photos. Unauthorized use, reproduction, or manipulation of photographs is prohibited.

RIGHT TO USE: The photographer may use any images for advertising, marketing, promotional purposes, social media, sample displays, and other print and digital applications.
LIMITATIONS OF LIABILITY: Kelly Ralph and Kelly Ralph Images are not responsible for any consequences arising from the use of photographs. Kelly Ralph and Kelly Ralph Images are not responsible for content uploaded by users. Kelly Ralph and Kelly Ralph Images are not responsible for any loss or damage arising from the use of the website, photographs, or photo shoots. If the Photographer cannot perform the Agreement due to a fire, casualty, strike or other civil disturbances, acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, then the Photographer shall return any moneys paid by the Client.

CANCELLATIONS: Kelly Ralph Images reserves the right to cancel or re-schedule any photo session with proper, formal written notice (email, text). The client retains the right to re-schedule the photo shoot with proper, formal written notice, 24 hours prior to the photo shoot. Written notice is required, even if the cancellation was discussed in a phone call. Definition of written: email, text.

All deposits and payments are final and are non-refundable. In the event of cancellation by the Photographer or re-scheduling by the client or Photographer, the received deposit will remain on file as a credit for 30 days, to be applied to a future booking or photo service. If a rescheduling is not made 24 hours prior to the photo shoot, the deposit is automatically forfeited. Late arrivals to a photo shoot, after a 5-minute grace period, will incur a $50 fee.
All arrangements shall be discussed between the Client and the Photographer and agreed-upon in writing. Clients are responsible for all location fees and permits.
FAILURE TO PERFORM: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Due to the limited and subjective nature of the photo session, the Photographer cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the session, or by the location restrictions. The Photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the clients or other principles. The Photographer is not responsible for the lack of coverage due to weather conditions, scheduling complications due to lateness of individuals, rules and restrictions of venue, or the rendering of decorations of the location. It is acknowledged that any lists submitted to the Photographer will be used for organizational purposes only and in no way represent photography that will actually be produced. The Photographer will do her best to fulfill all requests but can make no guarantees all images of those requests will be delivered.
